TERMS:
Ads produced by Two-Lane Livin' production department are sole property of Two-Lane Livin' and may not be reproduced, in part or whole, without permission. Original copies and reproduction rights for those copies may be purchased for a one-time fee of $50.00.
SPECIAL PLACEMENT
Special placement requires a 20% surcharge.
All placement requests are given full consideration, but placement absolutely cannot be guaranteed without payment of surcharge. Two-Lane Livin' is not liable for failure to accommodate placement requests unless the advertiser chooses to pay the special placement surcharge.
MISTAKES AND MAKE-GOODS
Two-Lane Livin' is not responsible for typographical errors unless such an error
was made by Two-Lane Livin's production staff. Two-Lane Livin' will only be
responsible for returning charge on the portion of the advertisement that was
rendered useless.
If a mistake in advertising occurs and is the fault of the publisher, remedies will be limited to whichever of the following options is appropriate:
a) cancellation or reduction of relevant production charges.
b) insertion of a “make-good” advertisement in the next available issue.
c) cancellation of charges for the portion of the advertisement rendered valueless by the error.
The publisher will assume no other responsibility for mistakes and the advertiser expressly agrees that a contract or insertion order shall not be invalidated by mistakes.
CREDIT AND PAYMENT POLICIES
Payment in advance is required for all new advertisers, all advertisers who have
not established credit with Two-Lane Livin', all transient advertisements, and
all short-term event advertisements. Once credit has been established,
advertiser will be billed upon publication.
In the event of nonpayment, Two-Lane Livin' reserves the right to hold advertiser and/or its advertising agency jointly and severally liable for such moneys as are due to Two-Lane Livin'. Advertiser and/or agency agrees to reimburse Two-Lane Livin' for court costs, attorney fees, and any other expenses incurred in the process of collecting debts due Two-Lane Livin'. Payment is due upon receipt of billing. An account balance older than 30 days is considered past due. A monthly finance charge of $10 will be added to all bills after 30 days. Accounts 60 days past due will be suspended, and billed at regular rates, thus forfeiting any discounts.
CONTRACTS
Advertising contracts must be fulfilled within one year from the first
insertion. Frequency discounts are for contracted advertisers only and are not
retroactive or transferable.
A “short-rate” billing will occur if a contracted advertiser does not complete a contracted frequency schedule. At that point, insertions that have been published at the contract rate will be recalculated at the frequency rate that has been earned, and the difference will be billed to the advertiser. Two-Lane Livin' reserves the right to run contracted ads over again if not notified of copy changes, and to bill the advertiser accordingly.
GENERAL POLICIES
Advertisements are accepted upon the representation that advertiser and agency
have the right to authorize publication of the contents thereof. In
consideration of such publication, advertiser and agency agree to indemnify,
defend, and hold publisher harmless against expense, claim, or loss arising out
of publication.
Publisher reserves the unrestricted right to reject any advertisement at any time with full reimbursement being made; furthermore, publisher shall not be liable for any costs or damages if for any reason it fails to publish an advertisement.
Advertiser agrees that all copy, layout, and composition of advertisements and content are the sole property of Stumptown Publishing, Inc., and may not be reproduced without the express written permission of Stumptown Publishing, Inc.
Two-Lane Livin' will not be bound by conditions printed or appearing on order blanks, copy instructions, or verbal agreements that conflict with the provisions of this rate card.
ONLINE ADVERTISING GUIDELINES
All advertisements will be reviewed by Two-Lane Livin' and are subject to
approval before placement on the site.
Advertisements cannot mislead the user. For example, they may not mimic or resemble Windows/Mac/Unix dialogue boxes, error messages, or the like.
Two-Lane Livin' reserves the right to preserve the user experience of its sites, and reserves the right to remove any advertisement that is deemed annoying and/or harmful to our users at any time.
